Mental health procedures frequently occur in a crisis situation. Whether it involves temporary custody, institutional placement, or a treatment order, we are accustomed to intervening in emergencies to ensure your rights are respected at every stage or to support you when your loved ones are going through a difficult time.

 

Temporary custody

When a relative of someone living with a mental health condition fears that they pose a danger to themselves or others, they can apply to the court for temporary custody so that the person can be assessed by a doctor. We represent families and individuals throughout this sensitive process, ensuring that everyone's rights are respected. A legal aid mandate may be available if the person making the application is eligible for legal aid.

 

Care in an institution

Involuntary commitment is an urgent measure imposed by the court when a person must be kept in a psychiatric facility for their own safety or the safety of others. We support our clients throughout these proceedings to ensure clear and attentive representation.

 

Treatment or care order

The court can order that a person receive medical treatment, even without their consent, when psychiatrists deem the person incapable of consenting to treatment and they categorically refuse it. We intervene to defend the rights of the individuals concerned and ensure that this measure is justified, regulated, and proportionate.

 

Accommodation order

A placement order can be imposed by the court when a person is deemed incapable of giving consent and categorically refuses to leave their living environment. This measure aims to compel someone to reside in a specialized housing facility, despite their objections. It can apply to individuals living with mental health disorders as well as those experiencing a loss of autonomy. At DUX, we represent those affected to ensure their rights are respected and that any decision regarding forced placement remains exceptional, justified, and proportionate.

The CETM adjudicates the cases of individuals found not criminally responsible or unfit to stand trial due to mental disorders. We offer attentive representation before this specialized administrative tribunal.
