Am I eligible for legal aid?

Updated: Mar 23

Legal aid is the Quebec system that allows people with low incomes to access a lawyer free of charge or at a reduced cost. To find out if you are eligible for legal aid, you must make an appointment at the Legal Aid Office in your region and complete a Legal Aid Application. The clerk will then assess your financial eligibility based on various criteria:

  • Your income and possibly that of your spouse;

  • Your assets and possibly those of your spouse;

  • Your cash reserves and possibly those of your spouse;

Individuals receiving social assistance benefits are automatically financially eligible for legal aid.

To find out the eligibility criteria, you can consult the Legal Services Commission website

Not all types of cases are covered by legal aid. However, cases involving youth protection (DPJ) and mental health are generally automatically covered by legal aid.

In some cases, legal aid can provide you with a lawyer. In other cases, you will need to contact a lawyer in private practice who accepts legal aid cases. Except in emergencies, it is best to begin the legal aid process before contacting lawyers in private practice. This demonstrates your seriousness and allows the lawyer to properly assess the scope of their intervention.

All our lawyers accept legal aid mandates. Every situation is unique. If you would like to discuss your case or obtain personalized advice, our lawyers are available to assist you: 438-838-6638 ext. 2 or by email at info@cabinetdux.com
